1. Acceptance of Terms:

By accessing and using this website and/or engaging our services, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you must not use our website or services.   

 

2. Scope of Services:

We provide HVAC installation, repair, maintenance, and related services as described on our website or in our service agreements. Specific services included in each job will be outlined in your estimate or service agreement. We reserve the right to refuse service for any reason.

3. Estimates and Pricing:

  • Estimates are provided based on the information available at the time of the assessment. Actual costs may vary depending on unforeseen circumstances or additional work required.

  • Prices quoted are valid for a specified period, as indicated on the estimate.

  • We reserve the right to adjust prices due to increases in material costs or other factors beyond our control.

  • Any additional work requested beyond the scope of the original estimate will be charged separately.

4. Payment Terms:

  • Payment is due upon completion of services unless otherwise specified in your service agreement.

  • We accept most Visa, MC, Discover, Amex, cash and check.

  • Late payments may be subject to interest charges at a rate of 10%.

  • For larger projects, a deposit may be required before work commences.

  • Financing options may be available through third-party providers, and are subject to their specific terms and conditions.

5. Warranties:

  • We provide a limited warranty on labor.

  • Manufacturer warranties apply to parts and equipment, and details are available upon request.

  • Warranties are void if equipment is misused, tampered with, or serviced by unauthorized personnel.

  • Warranty does not cover normal wear and tear, or damage due to acts of God.

6. Scheduling and Cancellation:

  • Appointments are scheduled on a first-come, first-served basis.

  • We require 24 hour notice for cancellations or rescheduling.

  • Cancellations made with less than the required notice may be subject to a cancellation fee of $150.

  • We will make every effort to arrive at scheduled appointment times, but delays may occur due to unforeseen circumstances.

7. Access to Property:

  • You agree to provide us with safe and reasonable access to your property to perform services.

  • You are responsible for ensuring that the work area is clear and free of obstructions.

8. Limitation of Liability:

  • We are not liable for any indirect, incidental, or consequential damages arising from our services.   

  • Our liability is limited to the cost of the services provided.   

  • We maintain appropriate insurance coverage.

9. Dispute Resolution:

  • Any disputes arising from our services will be resolved through good-faith negotiation.

  • If a resolution cannot be reached, disputes may be subject to mediation or arbitration.

10. Changes to Terms:

  • We reserve the right to modify these Terms and Conditions at any time.

  • Changes will be posted on our website and will be effective immediately.

11. Governing Law:

  • These Terms and Conditions shall be governed by and construed in accordance with the laws of Georgia, USA.

12. Force Majeure:

  • We shall not be liable for any failure to perform our obligations due to causes beyond our reasonable control, including but not limited to acts of God, natural disasters, or labor disputes.

13. Opt-In for Customers:

  • B&C Mechanical will collect verbal opt-ins from customers. Customers will be able to opt in to receive SMS notifications (e.g., billing, appointment reminders, dispatch updates, job completion surveys) either in person at your location or during a phone call initiated by the customer. Upon first registration, customers will be asked for their phone number and informed about receiving text messages. They will also be notified of possible message and data rates, variable message frequency, and instructions to text HELP for support or STOP to unsubscribe.
